- Agreement to Terms and Conditions
By purchasing any product from Scenic Pixel, you agree to these Terms and Conditions. If you do not agree to these Terms, you must not proceed to purchase or use any of our products.
- Licencing of Product
Upon purchase, you are granted a license to use the product solely for the Theatre Company, School, Organisation or individual that is specified during the checkout process.
This license permits the Authorised Organisation or person to use the product for the production specified.
- Usage Restrictions
- 3.1 The product may not be copied, shared, resold, or otherwise transferred to any third party, including other Schools, Theatre Companies, Organisations or Individuals.
- 3.2 The product may not be modified, edited, or altered in any way without prior written consent from Scenic Pixel.
- 3.3 Use of the product is limited to Theatrical productions staged by the Authorised Theatre Company, School, Organisation or individual
- Copyright and Intellectual Property
All products created and distributed by Scenic Pixel are protected by copyright. Ownership of the product remains solely with Scenic Pixel.
- Breach of Terms and Conditions
If at any point Scenic Pixel finds that you have breached any of these Terms, which includes unauthorised sharing, re-distribution or transfer of the product to third parties which constitutes copyright infringement. Scenic Pixel reserves the right to pursue legal action against any party or individual found in breach of these Terms.
- Indemnity
You agree to indemnify and hold harmless Scenic Pixel, its owners, employees, and agents, from and against any claims, losses, damages, or expenses (including legal fees) arising out of your breach of these Terms and Conditions or through the use of the product.
- Termination of Contract
Scenic Pixel reserves the right to terminate any license granted under these Terms and Conditions; at any point during the lifetime of the licence if a breach is identified. Upon termination of the contract, you must cease using any of the licensed product and destroy all copies in your possession
- Credit Requirements
- 8.1 Proper credit for the projection designs must be given in any marketing and promotional materials where the production creatives are credited, including but not limited to posters, programs, websites, and social media posts.
- 8.2 The credit should be written as one of the following:
- Projections – Scenic Pixel
- Projections created by Scenic Pixel
- 8.3 The Credits must not be omitted or altered in a manner that implies or directly attributes the projection designs to another individual or organisation.
- Amendments
Scenic Pixel reserves the right to amend these Terms and Conditions at any time.
Notice of any changes will be provided via our website or via email, and any continued use of the products purchased constitutes acceptance of the updated Terms and Conditions.
- Refunds
- 10.1 When you place an order with us for one or more of the projection packs, our service to you begins immediately as the process to fulfil your order will commence at that point. By accepting these Terms, you consent to us making the Product available to you within the 14 day legal cancellation period and you acknowledge that once you begin the download you will be unable to cancel the order. This does not affect your statutory rights if the Product is defective.
- 10.2 If you do wish to cancel your order, you must do so before the download has started. You should notify us that you wish to cancel your order by contacting us by Email (info@scenicpixel.co.uk) or by using the contact form scenicpixel.co.uk/contact when cancelling, please quote your order number.
- 10.3 If a particular Product becomes unavailable following purchase but prior to your first download of that Product, your sole remedy is a refund of the purchase price paid for the unavailable Product. Where, however, the Product becomes unavailable after you have downloaded at least one copy of the Product, you will not be entitled to a refund. We will not, in any case, be obliged to provide you with a copy of the Product (but we may choose to, in which case you will not be entitled to a refund).
- Defective and Replacement Products
- 11.1 If you receive a faulty or incomplete version of the projection pack, please contact us in the first instance via Email (info@scenicpixel.co.uk) or our Contact form scenicpixel.co.uk/contact
You will need to provide your order number and the details of the projection pack ordered with which you are experiencing issues. - 11.2 If you have suffered a loss of your projection pack through failure of your hardware device, damage, theft or destruction, we may, solely at our discretion, provide you with another copy of the purchased projection pack.
If you lose your Product in this way, please contact us via Email (info@scenicpixel.co.uk) or through our contact form scenicpixel.co.uk/contact and quote your order number.
